Matt Spahn of the Spahn Law Firm asks, “Are you prepared?  Does your family know your end-of-life preferences?”  His specialty is in Elder Law.  There are many “holes” in the system for the elderly.

A Durable Power of Attorney is a financial and legal Power of Attorney.  It allows the person with it to take care of your financial and legal needs when you are incapacitated.  A Medical Power of Attorney is a very powerful and important document and can even save your life.  If you become incapacitated, they can make medical decisions on your behalf.  It is important to also sign the HIPPA form to allow that person to know all of your medical information when the time comes.  (It is a good idea to place a magnet or note on your refrigerator that shows your Power of Attorneys contact information.

A DNR (Do Not Resuscitate Order) should keep you from being resuscitated once you meet the criteria you specified, however it is possible for family to override it in some cases.  The DNR is part of your Living Will.  Once you have the paperwork in order, you should tell your family what you have done and make your wishes known so there won’t be any issues when the time comes.

If someone has a lot of money, dies, and does not have a will, your loved ones will lose a lot of time and money.  Having a will may also help to avoid a lot of fighting over things after your death.  This is also where you would state guardianship desires for your children.  After you have done your legal will, it is time to make a statement in writing for your children to know what you want and expect of them.  This would be more personal than the legal will.
